Terms Of Use

The Purchaser hereby agrees to the following terms and conditions of subscription:

1.) Purchaser will pay the subscription fee as required by Phoenix Technologies & Solutions Inc. within the time frame specified.

2.) Phoenix Technologies & Solutions Inc. will have final approval of all content furnished by purchaser during use of MyPTSMail, blog, WIKI, personal webpage and forum services.

3.) If Phoenix Technologies & Solutions Inc. determines that the purchaser is furnishing inappropriate content during use of MyPTSMail, Phoenix at its option can terminate purchasers' subscription and can reimburse purchaser for unused subscription fee.

4.) The following content has been deemed inappropriate and includes but is not limited to: racism, pornography, obscenity, profanity, any illegal activity, content that the Department of Homeland Security of the United States Government deems to be an element of terrorist activity, threats to any individuals, groups, ethnic groups, gender groups, or any nationality, or content that promotes civil unrest. Phoenix Technologies & Solutions Inc. reserves the right to determine further inappropriate content and use not otherwise defined herein.

5.) Purchaser agrees to follow the commonly understood rules of civility.

6.) Notwithstanding the fact that the purchaser pays a subscription fee, it is agreed that it is a privilege, and not a right, to use MyPTSMail and that Phoenix Technologies & Solutions Inc. is the final arbiter regarding any determination concerning the appropriateness of any content. If Phoenix Technologies & Solutions Inc. determines to terminate purchasers use of MyPTSMail, the purchaser has no recourse. Phoenix Technologies & Solutions Inc. reserves the right to terminate any subscription without justifying its' decision.

7.) MyPTSMail is a term that includes the following services: e-mail, filters, web sites, blogs, WIKI, forums, instant messaging, and KidsPTSMail. This list of services includes options that a purchaser can choose and use if the required subscription fee is paid. Phoenix Technologies & Solutions Inc. reserves the right to eliminate or add services at will.
